Terms of Service Agreement

for Pool Service, Maintenance, and Repair with Risi Brothers’ Pools

General Provisions
-
These Terms of Service apply to all pool services, maintenance, and repair work provided by Risi Brothers’ (hereafter referred to as "the Provider").

By engaging the Provider’s services, the customer consents to comply with these terms and conditions.

Access and Safety Requirements
-
Customers must ensure that all pets are taken inside while technicians are servicing the property’s bodies of water to ensure the safety of both pets and technicians.

It is the customer’s responsibility to provide a safe working environment for the technician. Failure to do so will result in the customer being financially liable if technicians cannot perform duties due to unsafe conditions, such as, but not limited to, aggressive pets.

Any locked fences or gates must be unlocked and accessible for the technician upon arrival. If accessibility issues are anticipated, the customer must notify the Provider’s office 24 hours before the first scheduled visit.

The customer is responsible for ensuring that the bodies of water to be serviced and any associated equipment are accessible to the technician at the time of the scheduled service visit.

If there are any reasons that prevent access or if there are potential hazards present, it is the customer's responsibility to notify Risi Brother’s office in advance to facilitate safe and effective service.

Service Responsibilities

The weekly service technician is responsible for balancing chemicals in each body of water being serviced.

The technician will also note any equipment malfunctions or leaks and notify the customer, as well as the Provider’s office.

Customers are responsible for taking necessary actions to maintain equipment in good condition, ensuring water is safe for use.

Customers are responsible for ensuring there is accessible water on the property in order to fill pools, clean filters, etc..

It is the customer’s responsibility to notify the Provider’s office at least 24 hours in advance of any scheduled visit if there is an unusual condition in the pool, such as, but not limited to, excessive debris or algae growth. This ensures that the technician can prepare and bring any necessary additional resources or equipment to address these conditions effectively.

Fees and Charges

Cancellations made with less than 24 hours’ notice will incur a cancellation fee of $125.

Rescheduling requests made with less than 24 hours’ notice will incur a rescheduling fee of $60.
-
Customer credit cards on file will be charged the 7th of the month if invoices haven’t already been paid.

Weather and Equipment

In instances of severe weather conditions, services may be rescheduled. The Provider will communicate any changes at the earliest possible time.

The Provider is responsible for maintaining necessary chemicals and tools to perform weekly service duties. If customers prefer to supply their own chemicals, they must notify the Provider’s office 24 hours in advance of the scheduled visit.

Service Scheduling

The day of service and designated technician may be subject to change at the Provider’s discretion. The Provider will inform customers of any changes at least 24 hours before the scheduled visit.

Communication

Customers must ensure all contact details are up-to-date to guarantee effective communication regarding service schedules, changes, and notifications.

Amendments
-
The Provider reserves the right to adapt and modify these Terms of Service as necessary to respond to changing conditions, regulations, or business practices.

Customers will be notified of any changes or updates to the terms in advance, and such changes will take effect as specified in the notification.

Continued use of the Provider’s services after any modification to the terms will constitute the customer’s acceptance of the revised terms.

Payment Terms

Customers are responsible for making timely payments for all invoices issued by Provider.

Payments should be made in accordance with the payment terms specified on the invoice to avoid any service interruptions.

Termination of Services

Either party may terminate the services provided under this agreement with written notice to the other party.

The customer may terminate services with written notice 7 days in advance of scheduled visit provided to Provider.

Provider reserves the right to terminate services immediately for any violation of these Terms of Service, non-payment, or any other legitimate reason deemed necessary.

Upon termination, the customer is responsible for paying for any services rendered up to the termination date.

Agreement to Terms of Service

By utilizing the services provided by Provider, the customer agrees to abide by and be bound by these Terms of Service. If the customer does not agree with these terms, they should refrain from using the services. Confirmation of service will imply acceptance of these terms.
